What are the repercussions of playing music without the necessary permissions?

Copyright is a right given by law to creators of literary, dramatic, musical, and artistic works and producers of cinematographic films and sound recordings. In fact, it is a bundle of rights for reproduction, communication to the public, adaptation, and translation of the work. There could be slight variations in the composition of the rights depending on the work.

In terms of Section 51(a) of the Copyright Act, 1957, when any person without a rights granted by the owner of the copyright under the Act or in contravention of the conditions of a rights so granted or any of the conditions imposed by a competent authority under the Act, does anything, the exclusive right to do which is by the Act conferred upon the owner of the copyright shall be considered that the copyright shall be entitled to civil and/or criminal remedy conferred by law for the infringement of a right.
CAUTION! – Infringement of copyright attracts a heavy penalty which can extend upto a fine of Rs. 10,00,000/- (Rupees Ten Lac only) per song and imprisonment of 3 (three) years.

What is Public Performance?

“Public Performance” refers to the playing of music (sound recordings) by any premises/establishments where the communication of these sound recordings is to the public (multiple individuals) and not for personal consumption. This usage can be at, but is not limited to, hotels, discotheques, clubs, lounges, pubs, shops, stores, malls, salons, hospitals, offices, amusement parks, buses, taxis, aircraft, or any form of transportation that use sound recordings on a regular basis. In addition, playing recorded music at events, shows, parties, and social functions, with or without DJs, also falls under the purview of public performance.

Who needs a Novex Public Performance License?

Event Music License: Any corporate or individual using recorded music belonging to the Novex repertoire during the course of an event, be it a corporate/social/award show/fashion show or any other event will require a prior Novex Event License, which will be valid for the duration of the event only.
