The Grand Hotel Is Up For A Long Battle Over Music Copyright Violation.

The impact of the Copyright Laws has just steamed up! A renowned five-star hotel from Delhi, The Grand, has been caught in Copyright Infringement lawsuit. On 26th September 2016, they have been served an injunction, restraining them from using the Sound Recordings (of whose rights lie with Novex), until further court order.

This order against the luxury hotel was obtained from the Delhi High Court to address their failure towards procuring requisite Non-Exclusive Public Performance Rights in Sound Recordings for commercial purposes (Case No. : CS(COMM) 1351/2016 & IA No.12034/2016).

This legal case is based on the hotel’s violation of Music Copyright whereby they played ‘sound re-cordings’ for their patrons in the hotel, rights for which were owned by Novex Communications Private Limited.

Novex Communications is a pioneer in the copyright domain in certain music & entertainment in-dustries since last 15 years, engaged in monitoring the lawful use of copyrighted music across di-verse industries. Novex is an authorized agent of M/s. Yash Raj Films Private Limited and an as-signee of ZEE Entertainment Enterprise Limited, Shemaroo Entertainment Limited and M/s.EROS International Media Limited.

The negative impact of this lawsuit is not limited to the prolonged bad press and hefty compensa-tion. It also affects their Customers! A regular partygoer reiterates the role of quality music for visi-tors, “I usually hang-out with my friends or colleagues and unwind to good music. Such orders (in-junction on hit music) definitely affect my venue preferences. Music is THE most important aspect for me while choosing a partying venue”.

Despite pan-India adherence (by Hoteliers) to Copyright Laws, it’s unfathomable why few reputed hotels would choose to be complacent about purchasing legal rights for the music they use to enter-tain their patrons with.
